A SECOND accused person has appeared in court facing an attempted murder charge after the death of a man following a 'serious assault' in Irvine High Street.
Simon Roberts appeared from custody today (October 16) after the 36-year-old was arrested in connection with last month's incident.
Malcolm McCandlish has been named locally after the 43-year-old passed away in hospital on Monday (October 14), having been injured in the alleged attack on September 24 - footage of which was widely shared on social media.
Roberts, who is also accused of behaving in a threatening or abusive manner on the same date, made no plea during a private petition hearing at Kilmarnock Sheriff Court.
He faces a charge of assault 'to severe injury, danger of life and attempted murder' and a third charge of 'assault to injury'.
He was committed for further examination and has been remanded in custody, with a further hearing due to take place next week.
Co-accused Sean McKie faced four assault charges, including attempted murder, when he appeared from custody last week (October 9).
The 36-year-old is also said to have behaved in a threatening or abusive manner causing fear and alarm, and he was granted bail after entering no plea to the allegations.
A Police Scotland spokesperson said: "Officers were made aware of a 43-year-old man having been seriously assaulted at Irvine High Street around 6pm on Tuesday, September, 24, 2024.
“The man was taken to Queen Elizabeth University Hospital, where he died on Monday, October 14.
“A 36-year-old man has been arrested and charged in connection and appeared at Kilmarnock Sheriff Court on Wednesday, October 9.
"A further man, aged 36, has been arrested in connection with the incident.
"He was due to appear at Kilmarnock Sheriff Court on Wednesday, October 16."
